The Seller warrants that the Zero-Leak Gold plug/fitting will be free from defects in materials or workmanship which proximately result in leaks for the lifetime of the product. Misuse, cross-threading, over-tightening or other damage caused by inappropriate handling by persons or equipment as well as any alteration in any manner shall automatically void the foregoing warranty.

This guarantee and buyer’s sole and exclusive remedy is limited to the product replacement only, and does not apply to any non Zero-Leak Gold design or SAE design part of the fitting.

THE PARTIES AGREE THAT THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, ARE EXCLUDED FROM THIS AGREEMENT. WITHOUT LIMITING THE FOREGOING, SELLER SPECIFICALLY DISCLAIMS ANY CLAIM FOR CONSEQUENTIAL, INCIDENTAL OR INDIRECT LOSSES OR DAMAGES, LOST PROFITS OR BODILY INJURY.

Buyer shall not be entitled to make any claim hereunder unless notice of the defect or breach particularly describing the same and specifying the time and conditions of discovery of the same is given by registered letter, addresses to Seller at its head office, within 30 days after discovery. Seller shall have no obligation to make any product substitution unless and until the defective part has been returned to the Seller for inspection and verification of warranty coverage. In no event shall the Buyer, or its successors or assigns, whether by operation of law or otherwise, make any claim for, nor shall seller be liable for, consequential damages, secondary charges, incidental damages or other expenses, losses or liability resulting from any breach of the above warranty. The terms and conditions of this Agreement shall be enforceable only by the original buyer of the Zero-Leak Gold plug/fitting, and the rights herein shall not be assigned or transferred in any way, by operation of law or otherwise, to any other party or entity. This warranty and any claim hereunder shall be governed by and construed under the laws of the State of Indiana.
